General terms

The online store of Ellen Richard sells products (hereinafter referred to as the Products) owned by ELLEN RICHARD DESIGN OÜ. The conditions apply to the legal relationships that arise between the customer (hereinafter referred to as the Customer) and  ELLEN RICHARD DESIGN OÜ (hereinafter referred to as the Seller) as the owner of the shopping environment located on the webshop www.ellenrichard.com (hereinafter referred to as the Online Store) when Products are bought from the online store. In addition to these conditions, the legal relationships that arise when Products are bought from the Online Store are also regulated by the legislation of the Republic of Estonia.

Returns of the Products

The Customer has the right to return their ordered Product within 14 days. The 14-day term starts with receiving the package at the Customer’s address. The Seller shall refund the purchase price of the Product within 14 days of the timely arrival of the Product at the Online Store. The money is refunded to the same bank account from which the Customer paid for the corresponding order.

Kindly return the package in the same condition you received it in, and please reuse the box in which you received your item(s). Items should be returned unused and with all garment tags still attached. Returns that are damaged or soiled will not be accepted and will be sent back to the customer and/or a refund refused. Please send or bring the returns to Ellen Richard Design OÜ office, Kalaranna 8/12, Tallinn, 10415, tel. +372 56942755, or to the nearest SmartPost parcel machine (Balti jaam market)

In the case of refunding the purchase price, the Seller will not compensate for the cost of transport service related to this purchase. The Product that is to be returned cannot be damaged or have signs of having been worn, it must be in its original packaging and all original tags must be attached to the product. If the purchased product shows some technical mistakes from our end, and the product is damaged due to our sewing or construction mistake, the Customer can return the product and ask for a replacement or repair.

Prices

All prices displayed in the Online Store are given in euros (€) and include VAT 20%.

Products

All the Products displayed in the Online Store can be added to cart and are in stock. If the Customer places an order but it appears that the given Product is out of stock, the Online Store cannot execute that order. In this case, an employee of the Online Store will contact the Customer and offer a replacement product, a new possible time of delivery or a refund of the purchase price to the Customer no later than within 1- 3 working days.

Making a purchase

The Customer selects a desired Product and size from the Online Store and adds it to the shopping cart by clicking on the button “Add to cart“. To make a purchase, the Customer must click on the button “checkout”, after which the Customer is forwarded to the order placement page. After entering the required data, the Customer can pay for the product through an internet bank link or by card (ESTO AS) and confirm the order by clicking on the button “Return to Merchant”.

When the Customer has paid for the Product, the Online Store will send a confirmation to the Customer’s e-mail address. The Customer is obligated to provide the necessary and correct information when the order is placed. The Seller takes no responsibility for not being able to execute the order or any consequences that arise due to incorrect information given by the Customer during the placement of the order.

The Seller forwards the personal data necessary for making payments to the authorized processor ESTO AS

Methods of payment

The Customer can pay for their orders safely through ESTO (Estonian bank links LHV Bank, Swedbank, SEB Bank and with a credit card (Visa and MasterCard)). The payment is carried out outside the online store of Ellen Richard in a secure paying environment of the corresponding bank or service provider. The Seller does not have access to the Customer’s bank or credit card information.

The payment can be made also by wire transfer to Sellers account: LHV Bank,EE , Swift Code/BIC: . The order will be executed after receiving the wire transfer.

Delivery

The delivery is made by the client's chosen delivery method, i.e parcel machine, courier service (SmartPost) or studio pick-up. If the Customer placed their order during the weekend (from Friday after 17:00 until Monday before 08:00) or on a national holiday, the 5 working day term starts at 08:00 of the first working day that follows the weekend or national holiday. The Customer is obligated to check the correctness of their contact information before placing their order to avoid delays and misunderstandings when the Products are delivered. The Seller takes no responsibility for delays and misunderstandings upon delivery if the delay or misunderstanding arises from incorrect information given by the Customer during the placement of the order.

If the Product does not arrive in good condition and in closed packaging, the Customer is obligated to notify the Online Store, sending a corresponding e-mail to info@ellenrichard.com or calling +372 5110460.

Liability

The Seller and Customer shall be liable to each other for the damage caused by violating these terms of use in the cases and to the extent provided by the legislation valid in the Republic of Estonia. The Seller is liable to the extent of the purchase price. The Customer is obligated to use the service of the Online Store only for purposes that are legal and in accordance with good practice.

Privacy policy

The Customer gives the Seller a clear and informed consent for processing their personal data. The personal data given to the Seller shall be entered into the customer registry and will be used for providing sales service and offering products to the Customer. The Seller stores the contact information and information about the purchases entered by the Customer during purchases. This information will be handled as confidential and is processed in accordance with the Personal Data Protection Act. The personal data necessary for delivery will be forwarded to a business providing courier service.

The Seller may only use the Customer’s personal data for sending information about special offers and campaigns to the Customer’s e-mail address if the Customer has given their consent. Data exchange between the Customer and card payment centres is encrypted, ensuring the safety of the Customer’s personal data and bank information. The payment is carried out outside the online store of  Ellen Richard in a secure paying environment of the corresponding bank or service provider. The Online Store does not have access to the Customer’s bank or credit card information.

Terms of use and their alteration

Upon making a purchase, the Customer accepts the terms of use of the Online Store and is obligated to follow them. The contract of sale between the Seller and Customer enters into force after the purchase price is transferred to the Seller’s bank account. The Seller has the right to alter the terms of use and prices of the products of the Online Store. A notification about the changes made shall be published in the Online Store environment. The conditions and prices valid at the time of the transaction shall be applied to the transaction. The Seller has the right to disclaim the execution of the order when the displayed price in the Online Store is incorrect due to a technical error.

Other conditions

Any disputes between the Customer and the Seller shall be solved by negotiations. If an agreement is not reached, the Customer has the right to turn to the Harju County Court, Consumer Protection Board and/or Consumer Claims Commission to defend their rights.

For example, in the case of a 290-euro loan with a fixed interest rate of 14.90% per year for 12 months and a contract fee of 0 euros, the APR is 38.19%, the monthly payment is 28.67 euros, and the total amount to be repaid by the consumer is 344.04 euros. The final payment is a financial obligation, and before making a decision, thoroughly familiarize yourself with the terms of the contract and, if necessary, consult with an ESTO AS employee or other expert.
